Acceptable Use Policy
Gia Marine Intelligence LLC
This Acceptable Use Policy ("AUP") governs your use of the Gia Marine Intelligence platform (the "Service"). It is incorporated into the Terms of Service by reference. Violating this AUP may result in suspension or termination of your account.
1. Authorized Use
You may use the Service only for its intended purpose: searching, querying, and referencing technical marine documentation for vessels, engines, electronics, stabilization systems, and components that you own, operate, service, or sell through an authorized dealer relationship.
2. Prohibited Activities
2.1 Content extraction and competing services
You may not:
- Use the Service to systematically download, scrape, mirror, or extract manual content, page images, or knowledge base text in bulk;
- Use automated tools (bots, scrapers, headless browsers, API replay tools) to access the Service without our prior written authorization;
- Copy, reproduce, distribute, publish, or display manual content outside the Service;
- Create derivative works from manual content, including translations, summaries published elsewhere, or compilations;
- Use the Service or any content obtained through it to train, fine-tune, evaluate, benchmark, or otherwise develop any machine learning model, large language model, embedding model, or AI system;
- Use the Service to develop, design, or operate any competing product or service.
This applies to AI training in particular. The manual content available through the Service is licensed from manufacturers under terms that prohibit its use as training data. Using Service output to train any model — whether your own model, a third-party model, or fine-tuning an existing model — is a material breach of this AUP and the underlying license agreements.
2.2 Access control circumvention
You may not:
- Share your account credentials with anyone outside your organization;
- Allow more individuals than your subscription permits to use your account;
- Use the account of another person without their explicit permission;
- Attempt to access manuals, models, or organization data that your account is not authorized to access;
- Probe, scan, or test the vulnerability of any Gia Marine system without our prior written authorization (see our responsible disclosure policy for the authorized path);
- Defeat, bypass, or circumvent any authentication, rate limiting, billing enforcement, or access control measure;
- Use the Service from a country subject to U.S. comprehensive sanctions (currently Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions).
2.3 Safety-critical use
The Service is a reference tool for AI-generated responses. You may not:
- Rely on Service responses as the sole authority for any safety-critical decision, including but not limited to engine repair, electrical work, fuel system service, life-safety equipment maintenance, or structural modifications;
- Use the Service to assist anyone other than a qualified, trained operator or technician with the work being performed;
- Misrepresent Service output as having been verified by Gia Marine, the original manufacturer, or any third party.
You agree to independently verify all safety-critical information against the official physical manual or with an authorized service dealer before performing work.
2.4 Misuse and abuse
You may not:
- Use the Service to harass, threaten, defame, or harm any person or organization;
- Submit content that is unlawful, infringes third-party rights, contains malware, or attempts to inject or manipulate prompts to bypass safety guardrails;
- Interfere with or disrupt the Service, the servers or networks providing it, or any other user's enjoyment of it;
- Send spam, phishing, or other unsolicited communications through any feedback or support channel;
- Impersonate any person, organization, manufacturer, or affiliate.
3. Rate Limits and Fair Use
The Service is rate-limited to protect availability for all users:
- Chat API: 30 requests per minute per IP address (subject to change without notice).
- Login attempts: 5 per minute per IP address.
Repeated violations of rate limits or sustained usage patterns inconsistent with human use (sustained maximum throughput, perfectly periodic queries, identical query loops) may result in temporary or permanent suspension. Enterprise customers requiring higher volumes should contract for elevated limits in writing.
4. Reporting Abuse
If you believe another user is violating this AUP, email legal@giamarine.com with the subject line "AUP Report" and include the date, account or organization involved (if known), and a description of the conduct. We investigate all reports and may take action up to and including account termination.
5. Enforcement
We may, at our discretion and without prior notice:
- Issue warnings;
- Throttle or suspend an account temporarily;
- Terminate an account permanently;
- Remove specific content or organizational access;
- Refer matters to law enforcement or pursue civil remedies, including injunctive relief, where conduct rises to that level.
For severe violations — including content scraping, AI training use, credential theft, or fraud — we may terminate without prior notice and may pursue full damages permitted by law and by our contracts with content licensors.
6. Modifications
We may update this AUP from time to time. Material changes will be communicated through the Service or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised AUP.
